Education and Career

Artur Yemelianov was born on February 27, 1973, in Donetsk, Ukraine. He holds two higher education degrees from Donetsk State University: a law degree (1995) from the Faculty of Economics and Law, and an economics degree (1999) from the Accounting and Finance Faculty. In 2009, he defended his candidate's dissertation and received the degree of Candidate of Legal Sciences, focusing on the legal regulation of promissory notes in business.

Judicial Career

Yemelianov began his judicial career in 2000 when he was appointed as a judge of the Arbitration (Commercial) Court of the Donetsk Region for a term of five years. From 2001 to 2011, he rose through the ranks from judge to Deputy Chairman and then Chairman of the Donetsk Regional Commercial Court.

In 2011, Yemelianov was transferred to Kyiv, where he initially served as a judge and later as Head of the Kyiv Commercial Court. In 2012, he moved to the Kyiv Appellate Commercial Court, where he also became its Chairman.

Supreme Commercial Court of Ukraine

From 2013 to 2014, Yemelianov was appointed as a judge and then Deputy Chairman of the Supreme Commercial Court of Ukraine. After the events of 2013-2014, he resigned from his administrative position and resumed his work as a judge in the Supreme Commercial Court of Ukraine, first in the First (2014-2015) and then in the Fourth Judicial Chamber (2015-present).

Legal Views

Artur Yemelianov supports judicial reform that emphasizes the role of the Supreme Court, which should systematize judicial practice and introduce precedents for mandatory consideration by all courts. He believes this will ensure predictable judgments and discourage corruption by requiring court decisions to align with binding Supreme Court rulings.

Legal Proceedings and Political Persecution

In 2017, Yemelianov participated in the competition to fill the post of judge in the newly formed Supreme Court. At the same time, he faced allegations and criminal investigations by the General Prosecutor's Office and political activists. The accusations were based on the statements of a single judge who alleged Yemelianov's interference in the case distribution system while he was head of the Kyiv Commercial Court.

Yemelianov considers the proceedings against him to be politically motivated. He filed a lawsuit with the European Court of Human Rights alleging violations of his civil rights by investigators and the court. The case is currently under review by the ECHR.

In 2015, Liechtenstein authorities froze accounts linked to a Panamanian company that the Ukrainian Prosecutor's Office attempted to connect to Yemelianov. However, the case was closed due to a lack of evidence, and the accounts were unfrozen.

Yemelianov has also been the subject of defamatory media coverage in Ukraine. He has filed lawsuits to protect his honor, dignity, and business reputation.
